An auctioneer is defined as any person who sponsors a public competitive sale of property, both real and personal, by outcry to the highest bona fide bidder. Such a person, whether employing auctioneers to conduct an auction or conducting an auction themselves, and holding themselves out for public patronage or receiving fees or other compensation for these services, shall pay an annual license fee of five hundred dollars. No license shall be issued for a period of less than one year. Permits for auctions shall be obtained pursuant to Chapter 6.36 of this title. Auctioneers must conform to the provisions of Chapters 6.36 and 7.20 of this code. It is unlawful for any person to advertise for disposal, offer for sale, dispose of, or sell, or to cause or permit to be advertised for disposal, offered for sale, disposed of, or sold, at auction in the unincorporated areas of the county, or in any manner carry on or conduct, or cause or permit to be carried on or conducted, in the unincorporated areas of the county, an auction of any property of others, without first complying with the provisions of this chapter and obtaining a permit so to do. Auctioneers must conform to the provisions of Chapters 6.36 and 7.20 of this code.
