Writ of Execution

WRIT OF EXECUTION/GARNISHMENT INFORMATION

Upon receipt of an Execution/Garnishment, service is completed promptly.
 
If you are garnishing wages, bank account, or executing on a vehicle or cash drawer, you may receive payment or a letter within 4 to 6 weeks.

If garnishing wages, the employer has 20 days to respond to the interrogatory. If we do not receive a response, we do not follow-up since we are unable to force the employer to respond. It is up to you to follow-up on your case if you haven't received payment or a letter within 4 to 6 weeks. The maximum legal amount of a wage garnishment is 25 percent of the take home pay. However, it is up to the employer to determine the amount of net pay to be garnished from the defendants paycheck. The following are some reasons why you may not receive funds from a wage garnishment:

  1. Defendant has a prior garnishment
  2. Defendant does not make enough money to garnish.
  3. Defendant has a Child Support or IRS Levy.

Garnishing a bank account: When a payment is received from the bank that does not satisfy the judgement in full, you must refile in your local court.

If we execute a vehicle or property, the vehicle or property will be held for 10 days to give the defendant a chance to pay the judgment in full. If the defendant does not pay the judgment in full, we will set the vehicle or property for auction and notify you of the time and date of auction. You may attend the auction and bid on the vehicle or property.

All Execution/Garnishments expire after 180 days. If for some reason your judgment is not satisfied within the 180 days, you may refile in your local court.  Writ of Execution on Liens (real property) are good for 6 years.

When this office receives payment on a garnishment, we receipt the money, type a voucher and forward it to the Clark County Comptroller's Office. Your payment will be mailed to you by the Comptroller's Office within 15 working days.
