Henderson Justice Court is authorized by Nevada Revised Statutes to issue protection orders against Stalking and Harassment, Harassment in the Workplace, Sexual Assault and Protection of Children. Henderson Justice Court is not authorized to issue protection orders against domestic violence. Domestic Violence Protection Orders may be requested through the Family Court Division of the Eight Judicial District Court.
Henderson Justice Court has jurisdiction over cases when the conduct occurred in Henderson Township, or in cases where the person affected by the conduct was located in Henderson Township at the time the incident(s) occurred.
Parties:The person applying for the protection order is called the applicant. The person the protection order is requested against is called the adverse party.
Filing an Application for Protection Order:If an individual wishes to apply for a protection order, they must file with the court an Application for Protection Order (including the Temporary Protection Order Application Information). If the application is approved and a Temporary Protection Order is granted, the adverse party must be served with the Temporary Protection Order. The order becomes effective once it is served.
Filing a Motion to Extend Protection Order:If the applicant wishes to extend the time the Temporary Protection Order is in effect, they must file a Motion to Modify / Dissolve / Extend / Enforce Protection Order before the Temporary Protection Order expires. Upon filing a motion, and therein requesting an extended order, the court will schedule a hearing. The adverse party must be served with a copy of the Notice of Hearing. At the hearing the extension of the Temporary Protection Order will be considered and both parties may present evidence and witnesses.
