A protection order is a civil court order that aims to protect a person (the applicant) from harm or harassment by another person (the adverse party). The order outlines specific actions the adverse party is prohibited from doing and specific places the adverse party must stay away from to ensure the safety of the applicant. Violating the terms of a protection order may result in criminal charges.
Domestic Violence Protection Order: A domestic violence protection order is against someone with which:
• You have a child or children in common;
• You are married or were married;
• You are related by blood (not including siblings and cousins) or marriage; or
• You are dating or were in a dating relationship.
In Clark County, Domestic Violence Protection Orders are issued by the Family Court Division of the Eighth Judicial District Court. Henderson Justice Court does not issue Domestic Violence Protection Orders.
Stalking, Aggravated Stalking, Harassment, Sexual Assault, and Protection of Children Protection Order: A stalking, aggravated stalking or harassment protection order application may be filed in Henderson Justice Court if the incidents occurred in Henderson Township or if the person affected by the conduct was in Henderson Township at the time the conduct occurred. If you wish to apply for such an order, you must file an Application for a Temporary Order for Protection. The application and any accompanying videos, pictures, or documents must be filed in-person or via postal mail.
At the time of filing the Application for a Temporary Order for Protection, provide copies of any pictures, text messages, emails, police reports, etc. on 8½in. x 11in. standard paper. Additionally, videos must be saved and filed with the court on a removable portable storage device and stored in a format supported by Windows Media Player. Videos, pictures, and electronic documents will not be accepted via email.
Applications that are received after 4:00PM will not be reviewed until the following judicial day.
Harassment in the Workplace Protection Order: Only the employer of a business or the authorized agent (such as an attorney for the business) may apply for a Harassment in the Workplace Protection Order. If you are an employee being harassed in the workplace, your employer must apply for this type of protection order, or you must file a different type of protection order on your own behalf (e.g., Stalking, Aggravated Stalking, Harassment Protection Order).
If you wish to apply for such an order, you must file an Application for a Temporary Order for Protection Against Harassment in the Workplace. Unlike other types of protection orders, there is a bond required at the time of filing. The application and any accompanying videos, pictures, or documents must be filed in-person or via postal mail. At the time of filing the Application for a Temporary Order for Protection, provide copies of any pictures, text messages, emails, police reports, etc. on standard 8½in. x 11in. white paper. Additionally, videos must be saved and filed with the court on a removable portable storage device and stored in a format supported by Windows Media Player.
